This Service Agreement serves as a contract between MTS Chauffeur LTD and the customer. The terms and Conditions of this Service Agreement are as follows.

Introduction

Welcome to MTS Chauffeur LTD.

These Terms and Conditions outline the rules and regulations for the use of the MTS Chauffeur website located at https://www.mtschauffeur.co.uk and the services provided by MTS Chauffeur LTD.

By accessing this website or booking services through MTS Chauffeur LTD, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services.

Throughout these Terms and Conditions, the terms “Company”, “We”, “Us”, and “Our” refer to MTS Chauffeur LTD. The terms “Client”, “Customer”, “Driver”, “You”, and “Your” refer to the person or organisation using our services.

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

1. Services

MTS Chauffeur LTD provides chauffeur, airport transfer, corporate transport, and private hire vehicle services.

All bookings are subject to availability and confirmation by MTS Chauffeur LTD.

We reserve the right to refuse or cancel bookings where necessary for operational, safety, or legal reasons.

2. Bookings and Payments

Bookings may be made through the website, by telephone, or by email.

Payment may be required at the time of booking or prior to the journey depending on the service requested.

We accept the following payment methods:

  • Visa
  • Mastercard
  • American Express
  • Bank transfer
  • Invoice for approved corporate accounts

MTS Chauffeur LTD reserves the right to request advance payment or pre-authorisation prior to confirming a booking.

Prices may change without prior notice due to fuel costs, economic conditions, or currency fluctuations.

3. Waiting Time

Non-Airport Pickups: A 15-minute grace period is included. After this period waiting time charges may apply.

Airport Pickups: For international arrivals, a 60-minute grace period is included from the scheduled landing time. After the grace period, waiting charges may apply.

Waiting time rates:

  • Sedan: £55 per hour
  • SUV: £65 per hour

Hourly bookings require a minimum reservation of 3 hours.

4. Cancellations and No-Shows

If a booking is cancelled by the Customer:

  • Within 7 days before the service – 50% of the payment is non-refundable
  • Within 72 hours before the service – 100% of the payment is non-refundable
  • Multiple vehicle bookings cancelled within 7 days – all payments are non-refundable
  • Wedding bookings cancelled within 14 days – deposits are non-refundable

If the customer fails to appear at the agreed pickup time and location, the booking will be treated as a no-show and the full amount will be charged.

5. Vehicle Use and Passenger Conduct

Passengers must behave in a respectful and responsible manner at all times.

The following rules apply:

  • Smoking is strictly prohibited in all vehicles
  • Possession or use of illegal substances is strictly prohibited
  • Passengers must not cause damage to the vehicle

The driver reserves the right to terminate the journey if passengers behave in a dangerous, abusive, or illegal manner.

No refunds will be issued in such circumstances.

6. Damage and Cleaning Charges

Customers are responsible for any damage caused to the vehicle during the booking.

A minimum financial responsibility of £2,500 may apply for physical damage to the vehicle or equipment.

Cleaning charges may apply where excessive mess occurs, including vomiting or smoking in the vehicle.

Cleaning charges range from £100 to £1000 depending on severity.

7. Lost Property

MTS Chauffeur LTD is not responsible for items lost or damaged during transport.

Any items found may be returned to the owner where possible, but this cannot be guaranteed.

8. Driver / Chauffeur Partner Agreement

MTS Chauffeur LTD may allocate bookings to self-employed drivers or partner chauffeur companies.

By accepting work from MTS Chauffeur LTD, the Driver agrees to the following terms.

Independent Contractor Status

Drivers operate as self-employed independent contractors and are not employees of MTS Chauffeur LTD.

Drivers are responsible for their own expenses including:

  • vehicle costs
  • fuel
  • insurance
  • licensing
  • taxes

Nothing in this agreement creates an employment relationship.

Commission

MTS Chauffeur LTD retains 20% commission from each booking allocated to a driver.

The remaining balance is payable to the driver after deduction of the commission and any agreed charges.

Payment Terms

Driver payments are processed within 30 to 45 days after completion of the job, provided the service has been completed satisfactorily and any required invoices have been submitted.

Payments may be delayed where disputes or customer complaints are under investigation.

HMRC Tax Obligations

Drivers are legally responsible for declaring all income earned through MTS Chauffeur LTD to HM Revenue & Customs (HMRC).

This requirement arises under the following legislation:

  • Income Tax (Trading and Other Income) Act 2005
  • Income Tax (Self Assessment) Regulations 1992
  • Finance Act 2020 (Making Tax Digital)
  • Taxes Management Act 1970 (Self Assessment framework)

Drivers must ensure that all earnings are reported correctly and taxes paid in accordance with UK law.

MTS Chauffeur LTD also maintains financial records and complies with all reporting obligations to HMRC.

Licensing Compliance

Drivers must comply with all relevant UK private hire legislation including:

  • Local Government (Miscellaneous Provisions) Act 1976
  • Transport Act 1985
  • Road Traffic Act 1988

Drivers must maintain valid:

  • private hire driver licence
  • vehicle licence
  • hire and reward insurance
  • MOT certification where applicable

Failure to maintain valid licensing may result in termination of cooperation.

Non-Solicitation of Customers

Drivers must not directly approach or accept bookings from customers introduced by MTS Chauffeur LTD outside of the company booking system.

This restriction applies during cooperation and for 12 months after the last completed booking.

9. Data Protection

All customer and driver information is processed in accordance with:

  • UK General Data Protection Regulation (UK GDPR)
  • Data Protection Act 2018

Personal information will only be used for service delivery and business operations.

10. Website Use

All intellectual property rights relating to this website remain the property of MTS Chauffeur LTD.

Users must not:

  • copy website content
  • reproduce website materials
  • use the company brand without permission

11. Limitation of Liability

To the fullest extent permitted by law, MTS Chauffeur LTD shall not be liable for:

  • indirect losses
  • delays caused by traffic or weather
  • losses arising from third-party services

Nothing in these terms limits liability for death or personal injury caused by negligence or fraud.

12. Amendments

MTS Chauffeur LTD reserves the right to update these Terms and Conditions at any time.

Updated terms will be published on the website.

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
